This Policy applies to the personal information we obtain through our various sources, including websites, mobile applications, social media pages, supplier engagement, third-party sources, and engagement with our guests, contacts, and other relevant third parties.  Some of these channels may provide links to other third-party websites and features, or contain third-party cookies, that are not owned or controlled by DL. We are not responsible for the privacy practices of third parties, which are subject to their respective privacy policies.

We have developed this Policy to explain how we manage and use your personal information and to ensure we comply with our legal obligations under applicable data protection laws. It is important that you read this Policy carefully so that you are fully aware of how we collect and process your personal information.

Hotel Guest
A hotel "guest" is someone who makes a booking, or stays, or uses any of the services, at the Devoncove Hotel.

The personal information we collect about our guests may include name, email address, home and/or business address, phone number; bank account and payment card information; booking history; transactional data including details about payments to and from you and other details of products and services you have purchased from us; information relating to your use of our services, such as room preferences, special requests, feedback and survey responses; and marketing preferences. We will collect this personal information from you when you provide it to us by phone, email, post, through our website or in person.

The legal basis for us processing your personal information will typically be one of the following: your consent; performance of a contract with you or a relevant party; our legitimate business interests; or compliance with our legal obligations.  Where we rely on consent to process your personal information, you may withdraw that consent at any time by contacting by email to info@devoncovehotel.com

We intend to use your personal information (i) to fulfil your bookings and/or to provide services or facilities you request from us; (ii) to collect payment from you; (iii) to administer and manage our relationship with you, which may include asking you to complete surveys or feedback forms; (iv) where you have made a reservation with us, to send you information before your visit to confirm the reservation and to provide you with other information relating to your reservation which we think you may find of interest; (v) to send you marketing and promotional material where we think this may be of interest to you (unless you have objected to receiving this by contacting us; (vi) where required by law; and (vii) where necessary to protect your health or well-being or that of another individual.

Hotel Contacts
A hotel "contact" is someone who makes an enquiry, or contacts us, on our website or in person or by letter, phone, email or text

The personal information we collect about our contacts may include name, email address, home and/or business address, date of birth, phone number; and marketing preferences. We will collect this personal information from you when you provide it to us by phone, email, post, through our website or in person.

Marketing
You may receive marketing communications from us (i) if you have specifically requested that information from us; or (ii) by email, text or post if you are a guest and you have not opted out of receiving that marketing; (iii) by post, if you have not opted out of receiving that marketing.  Otherwise, we will not send you any marketing communications unless we have your explicit consent.

Please note, you can ask us to stop sending you marketing messages at any time either opting out if there is an “opt out” option or by contacting us by email to info@devoncovehotel.com.

Personal Information Request
Where we need to collect personal data by law or under the terms of a contract for services that we have with you and you fail to provide that data when requested, e.g. name, address, contact details, payment details etc. we may not be able to perform the services under the contract we have.  In this case, we may have to cancel a service you have booked with us but we will notify you if this is the case at the time.

Sharing Your Personal Information with Others
We will not disclose personal information we hold about you to any third party except where required by law or to companies in the DL group; to third parties who provide services to us, and act as data processors for us; to professional advisers including lawyers, bankers, auditors and insurers; to HM Revenue & Customs, regulators and other authorities who require reporting of processing activities in certain circumstances.  Also in the event that we divest any business or assets, we may disclose personal information we hold about you to the prospective and actual buyer of such business or assets. If a change happens to our business, then the new owners may use your personal data in the same way as set out in this Policy.  Please note that we do not allow our third-party service providers to use your personal data for their own purposes and only permit them to process your personal data for specified purposes and in accordance with our instructions.

Transferring your Personal Information outside the EEA
We do not intend to transfer any personal data we hold about you to a country outside the European Economic Area ("EEA").  If however we do transfer your personal data out of the EEA, we shall ensure a similar degree of protection is afforded to it by ensuring at least one of the following safeguards applies: (i) the countries to which it is transferred have been deemed to provide an adequate level of protection for personal data by the relevant regulators; (ii) we have put in place with the transferee specific contracts approved by the relevant regulators which give personal data similar protection to that it has in Europe; or (iii) if the transferee is in the US, it is registered with the EU-US Privacy Shield (or any similar replacement scheme)

We will only retain your personal information for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements.  To determine the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal requirements.  In some circumstances you can ask us to delete your data.

In some circumstances we may anonymise your personal data (so that it can no longer be associated with you) for research or statistical purposes in which case we may use this information indefinitely without further notice to you.  We will take all reasonable steps to destroy, or erase from our systems, all the personal information we hold about you when it is no longer required.

Your rights & access to your Personal Information

You have the right to request from us access to and rectification or erasure of your personal data, the right to restrict processing, object to certain processing and in some cases the right to data portability. DL uses third-party web analytics services in connection with some of its various channels which use cookies and similar technologies to collect data (such as IP addresses) to evaluate use of and interaction with the channels.

Processing your Personal Data
Processing means any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.

As your employer, DL has a legitimate need to process and retain information about you, including sensitive personal data.  Due to the nature of its business activities DL may need to process your personal data generally in relation to your employment and to enable you to perform your job. DL will retain and process your personal data lawfully and appropriately, including during the recruitment process, whilst you are employed, at the time when your employment comes to an end, and after you have left the business, all in accordance with this Notice. DL needs to retain your data for various reasons including legal requirements and the legitimate interests of the business.

Most of the information DL holds will have been provided by you, but some information may come from other internal sources, such as your line manager, or in some cases, external sources, such as a referee. The sort of information DL may hold includes your job application form and reference(s), the terms and conditions of your employment, information needed for payroll, benefits and expenses, contact and emergency contact details, holiday and sickness records, health, training records, appraisals, and appropriate disciplinary and grievance records. 

Sharing Your Personal Information with Others

Candidate Privacy Notice

This Notice describes how DL and its related companies handle and protect data to which DL is provided access regarding the recruiting process.   DL will process Candidate Data in accordance with this Notice, unless in conflict with requirements of applicable law, in which case applicable law will prevail.  If you decline to submit or make available your Candidate Data, it may affect your ability to apply for or receive an offer of employment.  This Notice does not form part of any contract of employment offered to candidates hired by DL.

Definitions
“Candidate Data” is identifiable information that an individual makes available to DL in connection with the recruiting process.  Candidate Data may include a variety of information, such as candidate status, work history/job data, education, compensation, employer feedback, questionnaire results, contact information, previous addresses or names, additional information provided by the candidate (e.g., a cover letter), driver’s license number as required for certain positions, references, and criminal history where permitted by law.

“Sensitive Candidate Data” is Candidate Data concerning nationality or citizenship, race or ethnic origin, criminal history, or trade union membership. DL does not request or consider information concerning religion, sex life or political opinions in connection with recruiting.

“Processing” refers to any action performed on Candidate Data, such as collecting, recording, organizing, storing, transferring, modifying, using, disclosing, or deleting.

By making available your Candidate Data, you confirm that you have reviewed this Notice and agree that DL may process your Candidate Data in accordance with this Notice; you have provided any notices and obtained any consents needed to provide information concerning others (e.g., information about employment references); and your Candidate Data may be transferred and processed worldwide, including the DL and other countries that may not be deemed to provide the same level of data protection as your home country, for the purposes and in the manner specified in this Notice.

Collection
You may use various electronic and paper methods to submit Candidate Data to DL.  You agree that, in addition to collecting Candidate Data directly from you, DL may collect Candidate Data from third parties, for example, from recruiters, in connection with a background or employment check or an employment reference (subject to your consent where required by law) or, to the extent permitted by law, from a recruiting or other web site.

Processing and Retention
DL processes Candidate Data for legitimate human resources and business management purposes. These include identifying and evaluating candidates for DL positions; record-keeping related to hiring processes; analyzing the hiring process and outcomes; and conducting background checks, where permitted by law.  In addition, Candidate Data may be used to comply with DL’s legal, regulatory and corporate governance requirements. If a candidate is hired, Candidate Data may be used in connection with his/her employment consistent with DL’s employment data protection policies. 

In addition to using Candidate Data for the position for which you have applied, DL may retain and use your Candidate Data to consider you for other positions.  If you do not want to be considered for other positions or would like to have your Candidate Data removed, you may contact DL at info@devoncovehotel.com.  Unless required for tax or other legal purposes or in connection with employment as specified above, Candidate Data will be retained for a maximum of three years (or less where required by law).

Sharing with Third Parties
DL may transfer Candidate Data to external third-party providers performing certain services for DL.  Such third-party providers have access to Candidate Data solely for the purposes of performing the services specified in the applicable service contract, and DL requires the providers to undertake security measures consistent with the protections specified in this Notice.

Disclosing Candidate Data
DL may be required to disclose certain Candidate Data to other third parties as required by law; to protect its legal rights to the extent authorized or permitted by law; in an emergency where the health or safety of a candidate or other individual may be endangered; or in the event of a re-organization, merger, sale, joint venture, assignment, or other transfer or disposition of all or any portion of DL’s business, DL may transfer Candidate Data to successor entities or parties.

International Data Transfers
Candidate Data may be transferred to and processed by other countries that may not be deemed to provide the same level of data protection as your home country.  DL maintains and applies employment data protection standards consistent with those specified in this Notice to its operations. 

Sensitive Candidate Data
DL may perform background and criminal checks where permitted by law, and may process other Sensitive Candidate Data, such as citizenship or nationality information or health information, when relevant for a position and permitted by law.  If DL intends to collect Sensitive Personal Data from third parties, you will be provided notice and the opportunity to consent.  If you have a disability and would like DL to consider an accommodation, you may provide that information during the recruiting process.   To the extent you make Sensitive Candidate Data available to DL, you consent to DL processing such Sensitive Personal Data in accordance with this Notice.

Security and Confidentiality
DL employs technical and organizational measures designed to protect the integrity, confidentiality, security and availability of Candidate Data, and to comply with applicable legal requirements for information security.   DL limits access to internal systems that hold Candidate Data to individuals who need access for a legitimate business purpose.

Candidate Rights
Under current data protection laws, you have certain rights in relation to your Candidate Data to access, correct and delete the personal information we hold on you.  DL will provide you access to your Candidate Data that DL holds to the extent required by law.  You may request correction or deletion of that Candidate Data, except where retention is required by your contractual relationship with DL, in the context of a legal dispute, or as otherwise required by law.  If access, correction or deletion is denied, the reason for the denial will be communicated to you.  DL generally does not make recruiting or hiring decisions based solely on automated decision-making within the meaning of the new data protection laws.  

In the event that DL relies solely on automated decision-making that could have a significant impact on you, DL will provide you an opportunity to express your views and will provide any other safeguards required by law. 

You may withdraw consent to the processing of your Candidate Data or submit inquiries, complaints and/or objections to the processing of your Candidate Data by sending a request in writing to info@devoncovehotel.com (clearly marked “FAO – Data Protection Team” in the subject line and sent high importance). The processes described in this Notice supplement any other remedies and dispute resolution processes provided by DL and/or available under applicable law.
